The Bharatiya Sakshya Adhiniyam, 2023 represents a transformative shift in India’s evidentiary law. Enacted to replace the Indian Evidence Act of 1872, this legislation aligns with the broader overhaul of the criminal justice system, complementing the Bharatiya Nyaya Sanhita, 2023 (substantive law) and the Bharatiya Nagarik Suraksha Sanhita, 2023 (procedural law). The primary aim of BSA 2023 is to redefine the framework for admissibility, relevance, and evaluation of evidence in judicial proceedings. It introduces clarity, consistency, and adaptability—especially in handling digital and electronic records - ensuring that the evidentiary process keeps pace with technological advancements.

The Act came into force on 25th December, 2023, officially repealing the Indian Evidence Act and establishing a new legal standard for courts across India.
